Return and Refund Policy

If, for any reason, You are not completely satisfied with a non-service purchase (such as a video),  We invite You to review our policy on refunds and returns. The following terms are applicable for any products that You purchased with Us.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular, plural, or possessive tense.

Definitions

For the purposes of this Return and Refund Policy:

  • Company (referred to as either "Evolve Pilates NW", "the Company", "We", "Us" or "Our" in this Agreement) refers to Evolve Pilates NW LLC

  • Content (referred to as "Content", "Materials") refers to videos, non-service packages, or Intellectual Property, as well as the organization and presentation of these things, specific to Evolve Pilates NW LLC 

  • Goods refer to the items offered for sale on the Service that are not in-studio classes that have already been attended.

  • Orders mean a request by You to purchase Goods from Us.

  • Service refers to the Website.

  • Website (referred to as "Website", "Site") refers to Evolve Pilates NW web portal, accessible from URL  https://www.evolvepilatesnw.com

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

The Company may revise and update these term of Return and Refund at anytime and without notice. You are cautioned to review the Return and Refund policy posted on the website periodically. Your continued access or use of this Website after any such changes are posted will constitute Your acceptance of these changes.

Your Order Cancellation Rights

In order to exercise Your right of cancellation, You must inform Us of your decision by means of a clear statement and confirm the request qualifies under the conditions outlined below.

 

You can inform us of your decision:

  • By email: evolvepilatesnw@gmail.com.   Please include info on what is being returned/cancelled, how much was paid, and when it was purchased.  The cancellation will register as a refund through the site, and You will receive any funds remaining after Wix transaction fees have been applied, and those fees will be returned through Wix to your method of payment used to purchase the class or product.

We will reimburse You no later than 14 days from the day on which We receive the returned Goods. We will use the same means of payment as You used for the Order, if feasible.

Conditions for Returns or Refunds

The following Goods cannot be returned or refunded:​

  • The supply of Goods which according to their nature are not suitable to be returned, deteriorate rapidly or where the date of expiry is over.  

  • Goods that were purchased on sale or on discount cannot be refunded through the website.

  • The supply of Goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

  • Video purchases.  Once user has purchased and accessed (or downloaded) a video, the video cannot be returned or refunded.

  • Zoom or In-Studio packages  where a class or session has already been used.   Packages are sold as a group, and are not eligible for refund after the first class has been attended

  • Zoom or In-Studio packages that were cancelled because of willful and deliberate violation of outlined Policies of the Company

  • Zoom or In-Studio sessions that have been missed by You.  Failure to attend a class is not grounds for a refund by the Company 

Zoom or In-Studio Classes that are cancelled by the Company, including for reasons of weather or illness, are eligible to be refunded, or credited for an alternative "make up" session of the same package at the earliest convenience that the Company can reasonably provide.   

Returning Goods

You are responsible for the cost and risk of returning the Goods to Us, and can coordinate on how, where, and when to send the Goods through the following email address:  evolvepilatesnw@gmail.com

We reserve the right to refuse returns of any merchandise that does not meet the above return conditions in our sole discretion.

Only regular priced Goods may be refunded. Unfortunately, Goods on sale cannot be refunded. This exclusion may not apply to You if it is not permitted by applicable law.

We cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.
